Abstract
It cannot be deduced that a subject cannot dispose of his or her own life only from the fact that suicide is not prohibited; nor that suicide is not a lawful act, as I have maintained in several previous works.I think that there is a right, even if it is limited before third parties, according to the situations established by article 143 CP and the Euthanasia Act of 2021, to the availability of one’s own life, and in this sense and from this criminal legal plane, the legal property that represents the object of protection can have an available character, and it is this extreme and its theoretical reasoning on the Spanish Constitutional basis that gives meaning to this paper.
