Abstract

The analysis of the Prevention of Labour Risks in the collective bargaining becomes an important element especially nowadays, when companies have to pass economic difficulties. We cannot permit that the right mechanisms to guarantee the security and safety of the workers are depended on the economic conditions. Although, the appearance of new labour risks and their regulation through norms and international Agreements, makes the collective bargaining the appropriate instrument to complete and develop the normative forecasts on prevention of labour risks. The harassment, mobbing and violence in work places, are considered as emergent risks in our days, and have been treated by the international instances. Really, the collective bargaining can contribute in a dynamic and actually way to regulate and establish the mechanisms to prevent those labour risks. The implication of the social partners in order to regulate and control these mechanisms is necessary to guarantee its applicability and effectiveness in the labour environment.
