Resumen

Este artículo analiza el fundamento y características del sistema de conformidad o plea bargaining de origen norteamericano, tanto en sus aspectos positivos como negativos. En particular se estudian los requisitos de la conformidad, su voluntariedad y su naturaleza jurídica. Se analiza el desplazamiento del juez como eje sustancial del procedimiento y la problemática de la condena a inocentes. También se hace referencia a la influencia de este sistema en el proceso penal español.
