Resumo

In principle, a comprehensive material regulatory system aims in principle to establish exhaustive regulation of all aspects of electronic commerce, that carried out through the Internet. However, e-commerce faces an ambiguous starting situation; appeared normatively with the legal bases of the old EC Treaty relating to the Internal Market (1986 draft in relation to the Single European Act) and its general principles, it is corrected in its protection of the e-consumer from the instruments issued from the corresponding Common Policy. This determines a context in which, although there are undoubted corrective effects, not only normative, but occasionally by European jurisprudence, there is no shortage of aspects of conflict, if not antinomies and misunderstandings.
